We have noticed an alarming pattern with the companies that Clarke Osborne has been a director of. As you can see, the average length of time that Mr Clarke Osborne keeps a company open appears to be, on average, two and a half years. Our question is, what happens to the assets, are they transferred to another company owned by Mr Osborne or one of his associates?
Further to this, and more disturbingly, Gaming International Ltd is part of Toklon Ltd which has a Deed of admission to an omnibus guarantee and set-off agreement. This is a written agreement through which a bank obtains a borrower's consent to seize his/her deposit(s) for non-payment of a loan or other obligations, or to offset credit balance of one account with the debit balance of another. Banks require this letter where they believe that their normal right to setoff, provided under law, may be challenged.
If Gaming International Ltd, and therefore Toklon Ltd, become the new owners of TUFC Ltd, they can (and may well) amend this agreement to include TUFC Ltd and Riviera Stadium Ltd but not Plainmoor. In addition to this, given the above, if Clarke Osborne follows the pattern seen above, it appears likely that he will quash TUFC Ltd. This will leave Plainmoor with no football team playing at the grounds, which then opens up the door for Gaming International to approach Torbay Council to have the Asset of Community Value removed (we believe that they would close Boots and Laces prior to this, as has been recently attempted).
TUFC will have to raise at lease £140,000 very quickly, in order to honour some of the debts, which includes: £36,000 to Pete Masters and £60,000 plus 10% interest to another party. This could be raised via the sale of cheap season tickets (because the club is lacking in sponsorships due to a large proportion of companies who are not prepared to take a risk at this time, even the shirt sponsor has pulled out). We are not saying that you shouldn't buy season tickets but if they were to quash the company your money would be gone. As fans, we ourselves, are waiting to see what unfolds before buying our tickets. In our opinion, it is clear that Dave Phillips and Pete Masters are involved in all of this and let's be perfectly honest, they are feeding the fans titbits in order stave off questions. We call upon all fans to demand that they come out with a full and honest statement and that they announce whether Kevin Nicholson, Steve Breed and the other staff are staying at the ground or not.
We also believe that some of the directors are not fully aware of what is going on, we may be wrong, but we do not believe that they would allow this to happen if they knew. Either way, it appears that we may all be sold out. Has the Chief Executive been made aware of everything and if not, Why not? As fans, we know that he has the clubs best interests at heart as we all do.
